Insurance Institute of Northampton members are invited to attend an interactive 'Mock Trial' CPD event arranged by Nottingham Insurance Institute:A Court Room DramaTuesday 3rd May 1.00pm - 5.00pm, atThe Galleries of Justice museum - Civil courtin conjunction with: Browne Jacobson LLP and Ropewalk Chambers~~~~~~~~~~~~~~~~~~~~~~~The trial is set in a post Insurance Act world and will focus on the new Duty of Fair Presentation and how it differs from the current disclosure obligations, changes to warranties and how those changes may impact on claims in practicePines Care Homes Ltd (PCH) is a small but successful company that owns and runs two care homes in the East Midlands. In mid-November 2016 PCH contacted their broker with an urgent enquiry. PCH was in the midst of a tendering process with their local Council to secure a renewal of its contract to provide disabled care home places. One of the Council's tender requirements was that PCH must have cyber risk insurance in place as part of the company's cyber security arrangements due to it handling personal data about council-funded residents.Following a series of unfortunate events, PCH became the victim of cyber extortion and confidential information concerning residents started to appear on line. A claim was submitted for the resulting costs that were incurred.PCH's claim has been rejected by their insurer and it is now for the Court to establish if the insurer was entitled to reject the claim.
