In this IIL accident lecture Richard Lawrence and Michael Salau will talk about the complexities of waste legislation/regulations and how breaches of the same can give rise to a claim under an insurance policy. The lecture will also give an overview on the potential costs associated with these claims and will provide an understanding of how coverage may vary under different types of policy in the market.

Richard will talk through two case studies, both of which relate to claims made under an insurance policy for the illegal importation, processing or depositing of waste on an insured premise. He will discuss where/how a legal liability attached to the insured party and how the policy responded (or did not as the case may be). He will also talk about how policy cover can differ for this type of incident both under the more station commercial forms and also under environmental impairment policies.

Michael, in contrast, will lead the talk with a summary of waste legislation and how legal liabilities may attach to 'innocent' landowners and site operators.

By the end of this lecture members would have gained an insight into:

  • Waste regulation/legislation
  • How a claim arising from breaches of such legislation may give rise to an insurance claim
  • How coverage may vary under different types of policy in the market
