Occupational stress claims in the modern workplace
In this IIL accident lecture Jason Bleasdale highlighted recent developments in respect of workplace stress, with a focus on mental health and also the impact of the modern workplace.
The definition of terms such as harassment and appropriate case law, including damages and how compensation is awarded. Distinctions between stress and psychiatric injury. Discussion on stress at work claims being something of an employment/personal injury hybrid. Establishing the forum through which claims can be pursued in Employment Tribunal or the High Court. What should employers be aware of when dealing with a case of occupational stress, and/or harassment and bullying? There are regulations and management standards which are helpful to employers, provided they are complied with. Discussions of Government commissioned reports, appropriate statistics showing the public perception of mental health and illnesses, along with international trends and developments.
How technology is affecting the issue of workplace stress and also how technology can help improve awareness and treatment of workplace stress.
By the end of this lecture members would have gained an insight into:
- Legal position and Duty of Care of Employers to employees
- What is compensatable, and what Damages awards are awards
- Recent developments in the law to include the impact of technology, the changing workplace and the public perception of mental illness
