Lost in translation: claims handling in UK and USA jurisdictions
In this IIL claims lecture Robert Cosgrove outlined how American English differences from 'proper' English can create difficulties in UK insurance litigation. Bob's presentation focussed on some common policy wordings and expressions that can result in coverage disputes and bad faith litigation.
Specifically, Bob spoke on how a word or phrasing that makes perfect sense in the London Market will not translate when placed before an American judge or jury. The lecture also discussed differences in the approach to mediation and ways Underwriters can avoid being dragged down into a bad faith quagmire.
By the end of this lecture members would have gained an insight into:

- The differences in mediation
- Ways to avoid bad faith traps

Bob, a former state prosecutor, is a founding partner of WCM's Philadelphia office. His practice focuses on the litigation of liability and coverage disputes in the US. He has more than 15 years experience in the London Market.
