London v New York insurance coverage law; what are the differences and why are they important?
In this IIL claims lecture Mark Kendall and Chris Novak highlighted the differences in approaches to policy interpretation and remedies between the London and New York courts. This included the differing obligations on an insured in presenting the risk and placement and some of the common misconceptions surrounding that.
Their talk primarily looked at the differences on the Duty of Fair Presentation, Rescission, Non-disclosure and misrepresentation, Policy interpretation, Aggregation, Breach of policy terms and exclusions and Damages for late payment v Bad Faith and punitive awards.
By the end of this lecture members would have gained an insight into:
- The key differences between London and New York when it comes to policy coverage
Speakers Bio's:
Mark Kendall is ranked by Chambers as a leading lawyer in insurance and reinsurance. His practice incorporates policy coverage and disputes, as well as international dispute management and UK litigation. He is the consulting editor of, and contributor to, the textbook "Product Recall, Liability and Insurance - a Global Guide" (Globe, 2012).
Christopher Novak's practice focuses on complex insurance coverage disputes involving environmental, pollution, product recall, commercial property and casualty insurance, professional indemnity, and financial institutions bonds.
