In this IIL lecture Clem gave an overview of the trends in IP litigation in the U.S., along with practical advice for managing the risk and costs of litigation.
Clem explained how IP litigation in the United States is changing rapidly. While the volume of lawsuits continues to be large, the use of specialised forums is increasing; early motions are proliferating; the risk of fee awards is rising rapidly, and copyright and trade-secret litigation are both becoming more common. His presentation surveyed those trends, their causes, and the pros/cons and costs of the various forums. Finally, Clem also looked at the most important strategies for managing the costs and risks of the various types of suits and the places where IP insurance can add the most value within that environment.
By the end of this lecture members would have gained an insight into:
- The top trends in IP litigation in the United States, including the use of early motions and specialised forums
- The key risks and costs a defendant should consider in managing IP litigation in the U.S.
- The ways in which IP insurance can provide the largest value add (hint: expertise, cost management, corporate lifecycle timing and settlement leverage)
