Covid-19 business interruption insurance claims continue to occupy the Courts’ time with a series of judgments handed down in late 2023 and early 2024 dealing with issues of policy trigger, claims adjustment and aggregation of claims. The principles established in these claims have application to business interruption more generally and indeed more broadly across all lines of insurance. In this webinar, we will provide an overview of significant matters and examine the most recent Covid-related case law and its impact on the insurance industry.
Mark Wing is a partner at Clyde & Co and a leading insurance lawyer working with property and casualty insurers. He has been very heavily involved in issues arising from the Covid-19 pandemic acting as global coordinating coverage counsel for a multinational insurer and working on most of the leading cases in the UK including the FCA -v- Arch Insurance test case to the Supreme Court, Greggs -v- Zurich Insurance dealing with issues of aggregation and claims adjustment and LIEC -v- Allianz Insurance dealing with “at the premises” disease clauses. He has been similarly involved in a number of other international events affecting the insurance market including the Port of Tianjin explosion in 2016 and the Japanese Earthquake in 2011. In the UK he advises on a wide range of insurance policy issues across the property, construction and casualty lines of business as well as working with insurers, brokers and their customers on managing risk issues including dealing with claims involving product liability, defective premises, and construction.
